Fleet Safety Communications and SMS Consent Policy
Company Name: SPEED INTERMODAL
Effective Date: 09/28/2021
Policy Owner: Fleet Safety Management
1. Purpose
SPEED INTERMODAL uses text messaging and other communication methods to provide commercial drivers with fleet safety information, including safety alerts, vehicle inspection reminders, preventive maintenance notifications, compliance updates, training information, and related fleet communications.
This policy explains the driver's responsibilities and provides consent for receiving fleet-related SMS messages.
2. Consent to Receive SMS Messages
By signing this policy, I agree to receive recurring SMS messages from SPEED INTERMODAL regarding:
- Fleet safety alerts
- Vehicle inspections
- Maintenance reminders
- Compliance notifications
- Driver safety training
- Vehicle recalls or service advisories
- Policy updates
- Other safety-related fleet communications
Message frequency may vary depending on fleet operations, safety requirements, maintenance schedules, and regulatory needs.
Message and data rates may apply depending on my mobile carrier plan. Consent to receive SMS messages is not a condition of employment, purchase, or continued service, except where separate legal or operational requirements apply.
3. Opt-Out and Assistance
I may opt out of recurring SMS communications at any time by replying:
- STOP to cancel or opt out
- HELP for assistance
I may also contact the Fleet Safety Manager or designated company representative for support.
Opting out of routine SMS messages does not eliminate my responsibility to receive or acknowledge required safety, compliance, maintenance, inspection, training, or regulatory information through another approved communication method.
4. Driver Mobile-Device Safety Responsibilities
Drivers must comply with all applicable laws and company policies regarding mobile-device use while operating a commercial motor vehicle.
Drivers must:
- Never read, write, send, or respond to text messages while driving.
- Review and respond to fleet messages only when safely parked and the vehicle is secured.
- Never use a mobile device in a manner that distracts from safe vehicle operation.
- Immediately report urgent safety, vehicle, accident, or mechanical concerns through the designated emergency or fleet-management process.
- Understand that SMS messages are not a substitute for emergency services or direct communication when an immediate hazard exists.
5. Driver Responsibilities
Each driver is responsible for:
- Providing an accurate mobile phone number.
- Promptly notifying SPEED INTERMODAL of any phone-number change.
- Reviewing safety and compliance messages as soon as reasonably possible when safely parked.
- Completing required inspections, maintenance, training, and compliance actions by the stated deadline.
- Following all fleet safety policies and applicable transportation regulations.
- Contacting Fleet Safety Management if a message is unclear, incomplete, or not received.
Failure to complete a required safety or compliance action may result in corrective action, additional training, restriction of vehicle use, or other action consistent with company policy and applicable law.
6. Emergency and Critical Notifications
SMS should not be the sole method used for emergency or life-safety communications. For urgent matters, SPEED INTERMODAL may also use telephone calls, email, dispatch communication, in-person notification, or another approved method.
Drivers must follow all emergency instructions provided by Fleet Safety Management, dispatch, law enforcement, emergency services, or other authorized personnel.
7. Privacy and Communication Records
SPEED INTERMODAL will use the mobile number provided by the driver for authorized fleet safety, operational, compliance, maintenance, training, and related communications.
Communication records may be retained for safety management, regulatory compliance, auditing, incident investigation, and documentation purposes, subject to applicable company policies and law.
